Terms, in plain words

The short version
- These terms are between us and the company that creates a WorKudos account. The person who creates it agrees for the company.
- Use WorKudos openly and lawfully: tell your people before anything is recorded, and never use it in secret.
- Your company's data stays yours. Export it any time; when you leave, we delete it within 30 days.
- During early access WorKudos is free and provided as it is. Either of us can stop at any time.
- We will tell you before these terms change, and before anything is ever charged.
1. The agreement
These terms are an agreement between [Legal name of the service provider] ("we", "us") and the company or organisation that creates a WorKudos account ("you", "your company"). By creating an account you confirm that you may agree to them for your company.
Our privacy policy is part of these terms. It explains what WorKudos records and how we handle it for you.
2. The service
WorKudos records work time on Windows PCs between Start Work and End Work, with each person's agreement, and turns it into days, timesheets and reports on our website. We keep improving it, so features may change; we won't take away something your company relies on without telling you first.
3. Early access and price
WorKudos is in early access and free to use. We may ask you for feedback. Before any part of it costs money, we will tell you the price in advance, and nothing is charged unless your company agrees to it.
4. Accounts
- The owner who creates the account invites people and decides their roles, and is responsible for what happens under the company's account.
- Keep passwords and 2-step sign-in codes private, and tell us at once at privacy@workudos.com if you think an account was misused.
- Each account is for one person; don't share it.
5. Using WorKudos fairly and lawfully
Your company agrees to:
- tell people before they are tracked why your company uses WorKudos, and let the app show them its notice and ask for their agreement;
- never use it in secret, or to watch anyone outside their work time;
- install it only on computers your company may lawfully monitor, and only for people aged 18 or over;
- follow the employment and privacy laws that apply where your people work, including any duty to consult them or their representatives; and
- have a person, not the app alone, make any decision about someone's job or pay.
You are responsible for your use of WorKudos and for the data your company decides to collect with it.
6. What isn't allowed
- Breaking the law, or helping anyone else to, with WorKudos.
- Trying to get into accounts, data or systems that aren't yours, or to test our security without our written permission.
- Copying, reselling or taking apart the software, or using it to build a competing product.
- Overloading the service, or getting in the way of other customers.
7. Your data
- Your company owns its data. We use it only to provide WorKudos to you, as the privacy policy describes.
- You can export your reports and timesheets as files at any time.
- If your company stops using WorKudos, or asks us to, we delete its data within 30 days, except what the law requires us to keep.
8. Our software and your ideas
WorKudos, its software, name and design belong to us. We give your company the right to use it while these terms apply. If you send us ideas or feedback, we may use them to improve WorKudos without owing anything for them.
9. Availability
We work to keep WorKudos running and your data safe, but during early access we can't promise it will always be available or free of errors. The desktop app keeps recording when it is offline and sends its records once it can.
10. Stopping
Your company can stop using WorKudos at any time. We can end these terms with 30 days' notice, or at once if they are seriously broken (for example covert monitoring), or to stop harm to people or to the service.
When they end, the data section above still applies.
11. Warranties and liability
WorKudos is provided "as is", without warranties beyond those the law requires.
As far as the law allows, neither of us is liable to the other for indirect or consequential losses, such as lost profits, and our total liability to your company is limited to the amount it paid us in the 12 months before the claim (or USD 100 while the service is free). Nothing here limits liability that the law doesn't allow to be limited.
Your company is responsible for claims that arise from using WorKudos against these terms or the law, for example tracking people without telling them.
12. Law and disputes
These terms are governed by the laws of India. We will first try to settle any disagreement by talking. If we can't, the courts of [City], India decide, unless the law where your company is based gives you the right to go to your own courts.
13. Changes to these terms
We may update these terms. We will tell company owners about important changes at least 30 days before they apply. If you don't agree, you can stop using WorKudos before then.
